JENIS-JENIS DADAH BERBAHAYA

Assalamualaikum,

Jom kita berkenalan dengan jenis-jenis dadah berbahaya di Malaysia.

Ini dinyatakan dalam Jadual Pertama, Akta Dadah Berbahaya 1952 ("ADB 1952").

Sebelum itu, "dadah berbahaya" atau "dangerous drugs" ditakrifkan dalam Seksyen 2 ADB 1952 seperti berikut:

"dangerous drug" means any drug or substance which is for the time being comprised in the First Schedule.

Lebih kurang maksudnya begini. Dadah berbahaya itu bermaksud apa jua dadah ataupun bahan yang mana pada masa itu terdapat dalam Jadual Pertama.

Ini bermakna jikalau terdapat jenis dadah tetapi pada masa itu tidak terkandung atau tidak disenaraikan dalam Jadual Pertama ADB 1952 bererti ia bukanlah bersifat dadah berbahaya mengikut undang-undang. Mungkin ia dadah berbahaya dari segi kesihatan saja. Jikalau memiliki atau menggunakan dadah tidak tersenarai tersebut bermakna tiada kesalahan jenayah dilakukan.

Bagaimana pula jenis dadah ini diketahui atau ditentukan? Ia perlu pengesahan oleh seorang pakar iaitu Pegawai Kimia atau Pegawai Sains kerajaan melalui laporan bertulis yang ditandatangani olehnya selepas analisis kimia dijalankan. Laporan ini dikenali sebagai laporan kimia di bawah Seksyen 399 Kanun Prosedur Jenayah.

PART V

PREPARATION FOR THE EXPORT OF WHICH EXPORT AUTHORIZATIONS ARE NOT REQUIRED

1. Deleted by PU(A) 151/2001

2. Preparations of cocaine containing not more than 0.1 per cent of cocaine calculated as cocaine base and preparations of opium or morphine containing not more than 0.2 per cent of morphine calculated as anhydrous morphine base and compounded with one or more other ingredients and in such a way that the drug cannot be recovered by readily applicable means or in a yield which would constitute a risk to public health.

3. Preparations of diphenoxylate containing, per dosage unit, not more than 2.5 milligrammes of diphenoxylate calculated as base and a quantity of atropine sulphate equivalent to at least 1 per cent of the dose of diphenoxylate.

4. Pulvis ipecacuanhae et opil compositus

10 per cent opium in powder
10 per cent ipecacuanha root, in powder
well mixed with 80 per cent of any other powdered ingredient containing no drug.

4A. Preparations of difenoxin containing, per dosage unit, not more than 0.5 milligrammes of difenoxin and a quantity of atropine sulphate equivalent to at least 5 per cent of the dose of difenoxin.

4B. Preparations for oral use containing not more than 150 milligrammes of dextropropoxyphene salts per dosage unit or with a concentration of not more than 2.5 per cent in undivided preparations.

5. Preparations conforming to any of the formulae listed in this Part and mixtures of such preparations with any material which contains no drug.
